Named insured

The person or organization shown on the declarations page as the policyholder. The named insured has the broadest rights and duties under the policy.

Also called: First named insured, Policyholder, Insured

The named insured is the person or entity listed on the declarations page as the insured. Policies give the named insured the most coverage and the most duties: paying premium, giving notice of claims, receiving cancellation notices and requesting changes. Other people and entities may be insureds too (employees, officers, additional insureds), but with narrower rights.

When a policy lists several named insureds, commercial forms usually give special duties to the first named insured, the one listed first. That entity typically receives cancellation notices and return premiums, and is responsible for paying premium.

How it shows up in an agency

A restaurant owner runs the business through “Elm Street Grill LLC” but owns the building in a separate real estate LLC. If the BOP lists only the operating company, the property LLC may have no coverage for its building or its liability as landlord. The account manager adds the real estate LLC as a named insured (or confirms how the carrier wants it scheduled) and checks that the legal names match the Secretary of State filings exactly.

Mismatched names are among the most common findings in policy checking: a DBA listed without the legal entity, an old entity name after a reorganization, or a newly formed subsidiary that was never added.

Common confusion

  • Named insured vs. additional insured. An additional insured is added by endorsement, usually for a contract, and only gets coverage for certain liability arising from the named insured’s work. They don’t pay premium or control the policy.
  • Named insured vs. loss payee. A lender with a financial interest in property is a loss payee or mortgagee, not a named insured.
  • DBA alone isn’t enough. A trade name isn’t a legal entity. List the entity, then “DBA” the trade name.
